Understanding Surrogacy Laws in Delhi
Legal surrogacy in India
This is Surrogacy Law 2023, which formulates the overall legal framework totally changing the surrogacy scenario in India. What was hitherto considered taboo has been legitimized but comprises a very strict law that applies to everyone involved in the process.
1. Eligibility Criteria: The intending parents should be of Indian origin;

Indian origin: Only Indian citizens can legally pursue surrogacy.

Marital requirements: The intending couple must have been married for at least 5 years.

Age limits: For women (intending mothers): 23 to 50 years, For men (intending fathers): 26 to 55 years.
3. Close Relatives as Surrogates: If surrogacy were confined to family members alone, then it would build trust and safety, with fewer emotional or legal problems. For the health of the surrogate mother as well as the child, she has to follow some medical laws.
4. Legal protection: The intended parents and the surrogate must have a notarized agreement that details their rights, obligations, and responsibilities to each other. This ensures they avoid misconceptions and clarity thus ensuring the surrogate consents to transfer the kid, and the parents pay all costs.
5. National Surrogacy Board: This is a new board that will oversee every stage of the process, and also contentious issues can be sorted out.
6. Grace period: Surrogacy agreements entered into before the law change will be honored during the grace period for existing contracts, but any new agreements must comply with the new rules.
Surrogacy Restricted Laws in India are given below:
There are various restrictions surrounding surrogacy in India. Only married heterosexual couples can use surrogacy. Homosexual couples are not permitted to use surrogacy.
The surrogate mother must consent to end the pregnancy and ensure that the child is born. The use of donor embryos is prohibited, but the embryo must be generated from at least one of the intended parents. Eggs for surrogacy may be donated by divorcees or widows between the ages of 35 and 45 years old. Children brought abroad for surrogacy cannot claim Indian citizenship either.

Is the surrogate medically insured and protected?
Yes, insurance for the surrogate is mandatory for 36 months under 2026 rules.
This covers pregnancy care, delivery, post-partum needs, and emergencies — and is included in the 18–20 lakh package in Delhi.
Do I need to bring my own surrogate in Delhi?
Yes. As per law, only altruistic surrogacy is permitted.
You must bring a willing surrogate who is:
a. Married (age 25–35)
b. Has her own biological child
c. Medically fit and approved by the board
(Clinics cannot provide surrogate mothers.)
What if the first embryo transfer fails?
Many reputed Delhi clinics offer up to 2 embryo transfer attempts within the same package.
For added peace of mind, some offer multi-cycle surrogacy programs — covering up to 3 embryo transfer attempts on the same surrogate (Rule 7, Surrogacy (Regulation) Rules, 2022), miscarriage, and legal re-approvals. Get these details in writing.
What is the total surrogacy cost in Delhi in 2026?
Most couples in Delhi spend ₹18–23 lakh from the first consultation to the baby’s birth certificate. The biggest parts are IVF, nine months of pregnancy care for the surrogate and the legal paperwork. Donor eggs, a C-section or a second transfer can push it higher.
Can I pay a surrogate in Delhi?
No. Paying a surrogate a fee is a criminal offence under the Surrogacy (Regulation) Act, 2021, in Delhi as everywhere in India. You may only cover her medical bills and the 36-month insurance policy the law requires.
Where do Delhi couples get surrogacy approval?
Delhi couples apply to the District Medical Board of their district for the eligibility and medical-indication certificates, and the surrogacy is then cleared under the Delhi State ART & Surrogacy Board. Your clinic usually helps you file the papers.
Will the baby be legally ours if born through surrogacy in Delhi?
Yes. Under the Surrogacy (Regulation) Act, 2021 a child born through surrogacy is the biological child of the intended couple, and the birth certificate is issued in your names. The surrogate has no genetic or legal claim.
Does a surrogate baby resemble the surrogate?
No. The embryo is created from your egg and sperm (or one donor gamete where allowed), so the baby inherits your features, not hers.
Is IVF or surrogacy cheaper in Delhi?
IVF is far cheaper: one cycle in Delhi costs about ₹1.5–2.5 lakh. Surrogacy costs ₹18–23 lakh because it adds the surrogate’s pregnancy care, insurance, delivery and legal approvals on top of IVF.
Can donor sperm or donor eggs be used in Delhi surrogacy?
Yes, since the March 2024 amendment, if a medical board certifies that one partner cannot provide gametes. At least one gamete must still come from the intended couple.
How many embryo transfer attempts are allowed on one surrogate?
A maximum of three, under Rule 7 of the Surrogacy (Regulation) Rules, 2022. Good Delhi clinics plan the transfers carefully rather than rushing them.
Is there any free or subsidised surrogacy in Delhi?
No government scheme in Delhi pays for surrogacy. Because surrogacy is altruistic, there is no fee to the surrogate, but the couple still pays for IVF, her medical care, insurance and legal work.
How many surrogacy clinics in Delhi are government-registered?
The national ART registry lists 163 registered ART clinics in Delhi (data as on July 2026). Always ask a clinic for its registration number before you sign anything.
