What Is Surrogacy in India?
Surrogacy in India is gestational — the surrogate carries an embryo created through IVF and has no genetic link to the baby. Under the Surrogacy (Regulation) Act, 2021, only altruistic surrogacy is permitted: the surrogate receives no fee beyond approved medical costs and insurance.

Who Is Eligible for Surrogacy?

Intending couple: woman aged 23–50, man aged 26–55, legally married, with a certified medical indication.

Single woman: only an Indian widow or divorcee, aged 35–45.

Surrogate: an ever-married woman aged 25–35, with a child of her own, acting as a surrogate only once, and medically fit.

Citizenship: foreign nationals and PIO cardholders are not eligible; OCI couples only with the required National Board recommendation.

Donor gametes (2024 rule): donor eggs and sperm are allowed. For a married couple, a donor gamete may be used when one partner has a certified medical condition — at least one gamete must come from the intending couple. A single widow/divorcee uses her own egg with donor sperm.
