The surrogacy process in India is regulated under the Surrogacy (Regulation) Act, 2021, which permits only altruistic surrogacy for Indian married couples who are medically proven to be infertile. The couple must first obtain a Certificate of Essentiality and Eligibility from the appropriate authority, after which they can proceed with choosing a surrogate mother—who must be a close relative, aged 25–35, married, and with at least one biological child. The surrogate can only be a surrogate once in her lifetime. Once a legal agreement is signed between the parties, the IVF procedure is carried out, and the surrogate carries the child to term. After birth, the baby is legally handed over to the intended parents, and the birth certificate is issued in their name.
