Under India's Surrogacy (Regulation) Act, 2021, surrogacy is permitted for single women under specific conditions. Eligible single women must be widowed or divorced, aged between 35 and 45 years, and must have a medical condition that necessitates surrogacy. The law prohibits unmarried women, single men, and same-sex couples from pursuing surrogacy. Additionally, only altruistic surrogacy is allowed; commercial surrogacy is banned. As per the Surrogacy (Regulation) Act, 2021, only Indian married heterosexual couples (married at least five years) are eligible for surrogacy.
